Terms of Service

These Terms of Service ("Terms") govern your use of Refactor (the "App"), provided by AppsKays Inc. ("AppsKays," "we," "us," or "our"). By creating a profile or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 18 years old to use Refactor. By using the App, you represent that you meet this requirement.

2. What Refactor Is — and Is Not

Refactor is a self-directed habit-tracking and behavior-support tool. It provides streak tracking, journaling-style logging, and grounding exercises (such as guided breathing) intended to support your own personal goals.

Refactor is not a medical device, and it does not provide medical advice, diagnosis, or treatment. The App is not a substitute for professional mental health care, medical care, or addiction treatment. Nothing in the App should be understood as a clinical claim about treating any diagnosed condition.

3. Your Account

Refactor allows anonymous or pseudonymous use. You are responsible for maintaining the confidentiality of your device and account access. You agree to provide accurate information (such as your age) where requested. You may optionally link a Google or Apple account to your profile so your progress can be recovered if you reinstall the App or switch devices; see our Privacy Policy for what information this shares with us.

4. Subscriptions, Free Trials & Billing

• Certain features require a paid subscription, which may include a free trial period as described at the time of purchase.
• Subscriptions automatically renew unless canceled before the end of the current billing period, in accordance with the policies of the Apple App Store or Google Play, through which all purchases are made.
• To cancel or manage your subscription, use your Apple ID or Google Play account settings — we do not have the ability to process cancellations or refunds directly, as this is handled by the applicable app store.
• Refunds are subject to the applicable app store's refund policy.

5. Acceptable Use

You agree not to: (a) use the App for any unlawful purpose; (b) attempt to reverse-engineer, decompile, or interfere with the App's operation; (c) misrepresent your identity or age; or (d) use the App in any way that could harm AppsKays or other users.

5a. Content-Blocking Feature

Refactor offers an optional, opt-in feature that restricts access to adult-content websites and apps on your device, implemented using your device's local VPN framework. This feature filters traffic entirely on your device — see our Privacy Policy for details on what is and is not collected through this feature. Enabling it requires your explicit in-app consent as well as a separate system-level permission from your device's operating system. You may disable this feature at any time. AppsKays does not guarantee this feature blocks all adult content in all circumstances and it should not be relied upon as your sole safeguard.

5b. Kayo (AI Companion)

Refactor offers an optional AI chat feature called "Kayo." Kayo is an artificial intelligence, not a real person, licensed therapist, counselor, or medical professional, and nothing Kayo says should be treated as therapeutic, medical, or crisis advice. Kayo sessions are limited to five minutes at a time. Messages you send to Kayo are processed by Google's Gemini API to generate a response — see our Privacy Policy for details. This feature is not a substitute for professional mental health care (see Section 2). If you are in crisis, see the crisis resources in Section 2 rather than relying on Kayo.

6. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY PARTICULAR OUTCOME (SUCH AS BEHAVIOR CHANGE) WILL RESULT FROM USING IT.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, APPSKAYS INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

8. Intellectual Property

The App, including its design, text, graphics, and underlying software, is owned by AppsKays Inc. and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

9. Termination

We may suspend or terminate your access to the App if you violate these Terms. You may stop using the App and delete your account at any time.

10. Changes to These Terms

We may update these Terms from time to time. Continued use of the App after changes take effect constitutes acceptance of the revised Terms.

11. Governing Law & Disputes

These Terms are governed by the laws of the State of New York, United States, without regard to conflict-of-law principles. Any disputes shall be resolved in the courts located in Erie County, New York, unless applicable law requires otherwise.
